UNCONTESTED DIVORCE

This is the most inexpensive and efficient way people divorce.  In uncontested divorce, you and your spouse acknowledge each other's obligation and agree on the terms of your divorce and file court papers cooperatively to complete the legal process. There will be no formal trial, and you probably won’t have to ever appear in court. Instead, you file court forms, such as a petition, and a marital settlement agreement that details your agreements about how you want to divide assets, debts, any support, and compensation.

Custody arrangements for your children will either be in the marital settlement agreement or in a parenting agreement that’s attached to the marital settlement agreement or stands alone as a separate agreement. Your settlement, and final divorce, will be approved by a judge. 

Many courts provide information and forms to make it easy to handle an uncontested divorce without a lawyer.  Different County may have different procedures, legal forms and fees; therefore check with your Family Court (Superior Court) for divorce proceeding.

If you and your spouse both stay on top of all the tasks you need to take care of, you should be able to finalize your divorce fairly quickly.
